Terms of Service
These terms apply when you use Bespoken, including the editor at app.bespoken.fm, podcast hosting, RSS feeds and the website at bespoken.fm. By creating an account or using the service you agree to them.
1. Who we are
Bespoken is provided by Bespoken AB (org.nr 559602-9909), Tallstigen 7, 139 71 Stavsnäs, Sweden. You can reach us at support@bespoken.fm.
2. The service
Bespoken is a web-based audio studio for podcasters. You can upload or record audio, get it transcribed, edit it through the transcript, use AI features that suggest edits, process and export audio, and publish episodes with hosting and an RSS feed. We keep improving the service, so features may change over time. If we remove a feature that is central to a paid plan, we will tell you in advance.
3. Payments through Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy a subscription or an AI top-up pack, you buy it from Paddle, and Paddle's buyer terms apply to the purchase. Prices are shown at checkout, including any applicable taxes.
4. Accounts
You need an account to use the editor. Give us accurate information, keep your login details safe and tell us if you think someone else has accessed your account. You are responsible for what happens in your account. You must be at least 18 years old, or have permission from a parent or guardian, to use Bespoken.
5. Subscriptions
- Paid plans (Standard and Pro) are billed monthly or yearly in advance and renew automatically at the end of each period until you cancel.
- You can cancel at any time from the Account page in the editor. The cancellation takes effect at the end of the current billing period, and you keep access to the paid plan until then.
- If you change plan, the new price applies as shown at the time of the change. If we change our prices, we will tell you before the change affects your next renewal.
- Refunds are described in our refund policy.
6. The Free plan
The Free plan is free of charge and has limits, currently 3 episodes, 5 GB of storage and 1 AI hour per month. The current limits are shown on our pricing page. Episodes published on the Free plan include a short spoken Bespoken promo at the start of the audio. After you upgrade, you can re-render your published episodes without the promo from the Account page.
7. AI hours and top-up packs
- AI features such as transcription and edit suggestions use AI hours. Each plan includes a monthly allowance, which resets at the start of each billing month and does not roll over.
- On a paid plan you can buy AI top-up packs. Packs are one-time purchases, do not expire and are used after your monthly allowance runs out, oldest pack first.
- AI output, such as transcripts and suggested edits, can contain mistakes. You decide which suggestions to accept and you are responsible for the final episode.
8. Your content
You keep all rights to the audio, transcripts and other material you upload or create in Bespoken. You give us a license to store, process, transcribe, render and distribute your content only as needed to provide the service to you, for example to host your episodes and serve them in your RSS feed. This license ends when you delete the content or your account, except for copies that podcast apps and listeners have already downloaded.
We may also use the audio and episode settings you choose, but never the audio itself, to improve Bespoken's audio processing, as described in our privacy policy.
9. Acceptable use
You may not use Bespoken to upload, publish or distribute content that:
- infringes someone else's copyright, trademark or other rights;
- is illegal, including content that sexually exploits children or incites violence;
- harasses, threatens or defames other people;
- contains malware, or is meant to disrupt or attack our systems or anyone else's.
You may also not use the hosting as a general file store or content delivery network for material that is not a podcast, try to get around plan limits, or resell the service without our permission.
You confirm that you have the rights you need for everything you publish, including music, sound effects, clips from other works and recordings of your guests, and that your guests have agreed to be recorded and published.
10. Copyright and takedown
We respect intellectual property rights. If you believe content hosted on Bespoken infringes your copyright, send a notice to copyright@bespoken.fm. This address is also our single point of contact under the EU Digital Services Act for notices about illegal content. A notice should include:
- your name and contact details;
- a description of the work you believe has been infringed;
- the URL of the episode or feed, and where in the episode the material appears;
- an explanation of why you believe the content is infringing or illegal;
- a statement that the information in the notice is accurate and made in good faith, and that you are the rights holder or authorized to act for them.
When we receive a valid notice we act on it promptly, normally by removing or unpublishing the episode or, where needed, the whole feed. We tell the account holder what was removed and why.
If your content was removed and you believe that was a mistake, or that you have the right to publish it, you can send a counter-notice to the same address. Explain why, include your contact details and confirm that the information is accurate. We forward the counter-notice to the person who sent the original notice, and we may restore the content if they do not show that they have taken legal action.
We close the accounts of users who repeatedly infringe other people's rights.
11. Suspension and termination
You can stop using Bespoken and delete your account at any time from the Account page. Deleting your account removes your projects, audio and published feeds and cancels any subscription. If a published file can't be removed right away, we keep retrying automatically until it is gone, and you can always contact us about it. We may suspend or close your account, or remove content, if you seriously or repeatedly break these terms, if the law requires it, or if your use puts the service or other users at risk. Where reasonable, we warn you first and give you a chance to fix the problem and to export your content. If we close a paid account without you having broken these terms, we refund the unused part of your current period.
12. Liability and disclaimers
We work hard to keep Bespoken available and your content safe, but the service is provided as it is and as available. We do not promise that it will always be uninterrupted or free of errors. Keep your own copies of important recordings.
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost audience or lost data, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as liability for gross negligence or intent, or your rights as a consumer.
13. Changes to these terms
We may update these terms. If a change is significant, we will tell you by email or in the editor at least 30 days before it takes effect. If you do not agree, you can cancel before the change applies. The date at the bottom of this page shows when the terms were last updated.
14. Governing law
These terms are governed by Swedish law. Disputes are settled by Swedish courts. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can also bring a claim in your local courts. Consumers in the EU can also turn to the Swedish National Board for Consumer Disputes (ARN).
